The trust is pleased to announce that it has successfully registered the nameplates of our locomotive, "SIR NIGEL GRESLEY" as our registered trademark. The registration number is 2376185 as of the date of 20th October 2004 and is dated 22nd July 2005. It covers the nameplate with either the black or red background colour.
Anyone wishing to make any commercial use of a likeness of our locomotive featuring the nameplates or who has done so since 20th October 2004 is invited to contact Trevor Hammond at the above address regarding a licence. Please note that permission shall not be unreasonably withheld and, for small cottage industries a fee will not normally be expected. (Please note that individuals making items for their personal use are exempt from these requirements). Larger commercial operations will be expected to offer a fee of reasonable and realistic proportions to the commercial value of the item.
The areas covered, as examples but not to be considered the definitive list, include Models featuring the nameplates, mouse mats, packaging, jigsaw puzzles, mugs, computer software items, paper goods etc.
While there will be an initial period of grace to allow arrangements to be made, after a reasonable period the trust will enforce its rights against commercial undertakings breaching our Trademark rights.
Organisations currently with permission to use our registered trademark include: HORNBY HOBBIES LTD., BACHMANN INDUSTRIES EUROPE P.L.C., FOX TRANSFERS AND TREASURE ISLAND PRODUCTS.
The public is also requested to consider carefully the purchase of any items, which use our Trademark, for which there does not appear to be any licensing arrangement in force.
The trust wishes to stress that as a registered Charity all income goes directly towards the overhaul, preservation and operation of our famous locomotive and that therefore it must be correct for any commercial organisation wishing to profit from our locomotive to support us in our aims.
